Terms of Service

1. Acceptance of Terms

By accessing or using Loqqit ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice before any material changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

2. Description of Service

Loqqit is a property management platform designed for landlords to manage rental properties, tenants, leases, payments, expenses, and related documents. The Service includes:

  • Property and unit management
  • Tenant and lease tracking
  • Payment recording and rent roll reports
  • Expense tracking and Schedule E reporting
  • Document storage (Pro plan)
  • Smart Document Scanning (Pro plan)
  • Maintenance request management

Important: Loqqit is a management tool only. We do not provide legal, tax, financial, or professional advice. Consult qualified professionals for such matters.

3. Account Registration

To use Loqqit, you must:

  • Be at least 18 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized account access
  • Accept responsibility for all activities under your account

You may not share your account credentials or allow others to access your account. Each user must have their own account.

4. Subscription Plans and Billing

4.1 Free Plan

The Free plan includes management of up to 3 properties with rent collection (ACH), basic rent tracking, expense logging, and maintenance requests. Document storage and Smart Document Scanning are not available on the Free plan.

4.2 Pro Plan

The Pro plan is available for $19 per month (or $15 per month when billed annually) and includes up to 10 properties, next-day rent payouts, document storage, smart document scanning, and Schedule E tax reports.

4.3 Growth Plan

The Growth plan is available for $39 per month (or $29 per month when billed annually) and includes up to 25 properties, everything in Pro, autopay for tenants, vendor management, portfolio P&L reports, and up to 5 team members.

4.4 Early Access Features

Certain features may be designated as "Early Access" or "Beta." These features are still under active development and may not perform as expected. Specifically:

  • Smart Document Scanning: This feature is currently in early access. We are continuously training and improving our scanning model to enhance accuracy. Results may vary depending on receipt quality, formatting, and legibility. You should always verify extracted data before relying on it for tax or financial purposes.

Early access features are provided "as is" without warranty. We appreciate your feedback as we work to improve these features.

4.5 Billing

  • Paid subscriptions are billed monthly or annually in advance, based on your selected interval
  • Subscriptions automatically renew unless cancelled
  • You may cancel at any time; access continues until the end of the billing period
  • We do not provide refunds for partial billing periods
  • We reserve the right to change pricing with 30 days' notice

4.6 Downgrade

If you downgrade to a plan with a lower property limit than your current portfolio, you will retain read-only access to all properties beyond the new limit but cannot add new ones until you are within the plan's limits or upgrade again.

5. Communications and Email

By creating an account, you agree to receive the following communications from Loqqit:

5.1 Transactional Emails

You will receive essential service-related emails including:

  • Account verification and security notifications
  • Password reset requests
  • Billing and payment confirmations
  • Important service updates and maintenance notices
  • Lease expiration reminders and alerts
  • Payment due notifications
  • Document expiration alerts

These transactional emails are necessary for the operation of your account and cannot be opted out of while maintaining an active account.

5.2 Marketing Communications

You also agree to receive marketing and promotional emails including:

  • New feature announcements
  • Tips and best practices for property management
  • Special offers and promotions
  • Newsletters and product updates
  • Surveys and feedback requests

You may opt out of marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by updating your preferences in your account settings. Please note that opting out of marketing emails does not affect transactional emails.

6. User Data and Privacy

You retain ownership of all data you submit to Loqqit ("User Data"). By using the Service, you grant us a limited license to store, process, and display your User Data solely to provide the Service.

  • We will not sell your User Data to third parties
  • We implement industry-standard security measures to protect your data
  • You may export your data at any time
  • Upon account deletion, we will delete your data within 30 days, except as required by law

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use automated means to access the Service without permission
  • Impersonate any person or entity
  • Use the Service to harass, abuse, or harm others
  • Store or transmit content that infringes intellectual property rights

8. Intellectual Property

The Service, including its software, design, logos, and content (excluding User Data), is owned by Loqqit and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Factors beyond our control (internet outages, third-party service failures)

We recommend maintaining your own backups of critical data.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
  • WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES

11. Indemnification

You agree to indemnify and hold harmless Loqqit, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

By You: You may terminate your account at any time through the account settings or by contacting support. Upon termination, your right to use the Service ceases immediately.

By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with 30 days' notice (except in cases of serious violations, where immediate termination may occur).

Effect of Termination: Upon termination, you may request export of your data within 30 days. After this period, your data will be deleted.

13. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution: Before filing any claim, you agree to attempt to resolve disputes informally by contacting us at support@loqqit.com. We will attempt to resolve the dispute within 30 days.

Arbitration: If informal resolution fails, any dispute shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration shall take place in Delaware or remotely at your option.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

14. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Loqqit regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger or acquisition.
